These Terms and Conditions ("Terms") govern your access to and use of the services provided by The Popular Concepts ("we", "us", or "our") through the website tpcsaas.in and our enterprise communication SaaS platform ("Platform"). By accessing or using our Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering for, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Description of Services

The Popular Concepts provides enterprise Software-as-a-Service (SaaS) solutions including but not limited to:

• WhatsApp Business API integration and management
• RCS (Rich Communication Services) messaging platform
• Agentic Bot and AI-powered conversational automation
• Unified Chat omnichannel inbox
• Workflow Automation tools
• Enterprise APIs and developer tools

3. Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

You agree not to use the Platform to:

• Send unsolicited or spam messages to any recipient
• Transmit content that is unlawful, harmful, threatening, abusive, or defamatory
• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the intellectual property rights of any third party
• Attempt to gain unauthorized access to the Platform or its related systems
• Interfere with or disrupt the integrity or performance of the Platform
• Use the Platform for any purpose that violates messaging channel policies (WhatsApp, RCS, etc.)

5. Service Level Agreement

We strive to maintain 99.99% platform uptime for cloud-hosted SaaS deployments. Scheduled maintenance windows will be communicated in advance. On-premise and hybrid deployments are subject to separate SLA agreements as defined in your service contract.

6. Fees and Payment

Access to the Platform requires payment of applicable fees as outlined in your service agreement or pricing plan. All fees are exclusive of applicable taxes unless stated otherwise. We reserve the right to modify pricing with 30 days prior written notice to active subscribers.

7. Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, software, and documentation, are owned by The Popular Concepts and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. We process data in accordance with applicable data protection laws. You retain ownership of your customer data transmitted through the Platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law, The Popular Concepts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Platform.

10. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our sole discretion with reasonable notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or Platform notification at least 15 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
